Richmond hotel owner found violating labour code: B.C. labour board

Under the labour code, it's illegal to replace workers while they are at the bargaining table and on strike.

The B.C. Labour Relations Board has instructed the owner of a Richmond hotel to pay damages to union workers who are on strike.

Employees of Radisson Blu Vancouver Airport, under the union Unite Here Local 40, went on strike in May 2021.

During this time, the hotel was found to have breached the Labour Relations Code by hiring replacement workers for housekeeping for six days and maintenance work for three days in 2023, according to a decision by Carmen Hamilton, vice-chair of the B.C. Labour Relations Board.

Under the labour code, it is illegal to replace workers while they are at the bargaining table and on strike.

Hamilton ordered the hotel to cease and desist having any replacement workers while employees were on strike and at the bargaining table.

Radisson Blu Vancouver Airport has also been ordered to pay the union damages for the lost wages to housekeeping employees for the six days and the maintenance employees for the three days they hired replacement workers, reads the decision report.

In addition, a special investigation officer from the B.C. Labour Relations Board will be visiting the hotel to observe how work is being done.

The officer may also conduct interviews with anyone working at the hotel to report back to the labour board.
